Acceptable Use Policy

This policy sets out the rules for using NixAPI. It applies to you, your API keys and anyone who uses the Service through your product.

1. Scope

This Acceptable Use Policy (“AUP”) forms part of the Terms of Service between you and NixAPI (“NixAPI”). It applies to all use of the Service, including use by your end users through any application you build on it.

Because every request is fulfilled by a third-party model, you must also comply with the usage policies of the relevant upstream provider, including but not limited to the OpenAI Usage Policies, the Anthropic Usage Policy, the Google Generative AI Prohibited Use Policy and the equivalent policies of other model developers. Where those policies are stricter than this AUP, the stricter rule applies.

2. Illegal activity

Do not use the Service to engage in, promote or facilitate any activity that is illegal in your jurisdiction, the jurisdiction of your end users, or the jurisdictions where we or our upstream providers operate, including:

  • trafficking of drugs, weapons, humans, wildlife or other illegal goods and services;
  • money laundering, terrorist financing, illegal gambling or pyramid schemes;
  • evading sanctions or export controls, or providing the Service to sanctioned persons or regions.

3. Harmful content

Do not generate, request or distribute content that:

  • sexually exploits or endangers minors in any way — including sexualized depictions of minors — which we report to the relevant authorities;
  • provides meaningful help in creating biological, chemical, nuclear or radiological weapons, explosives or other weapons capable of mass harm;
  • promotes, glorifies or incites terrorism, violent extremism or violence against people;
  • encourages or instructs suicide, self-harm or eating disorders;
  • harasses, threatens, bullies or intimidates others, or attacks people based on protected characteristics such as race, ethnicity, religion, gender, sexual orientation or disability;
  • is sexually explicit where prohibited by law or by the upstream provider, or involves non-consensual intimate imagery.

4. Deception and misinformation

Do not use the Service for:

  • fraud, scams, phishing, fake reviews, or other deceptive schemes;
  • impersonating real individuals, organizations or government bodies, or creating deepfakes of real people without their consent;
  • large-scale disinformation, election or political manipulation, or coordinated inauthentic behavior;
  • presenting AI-generated content as human-made where the law or context requires disclosure;
  • generating spam or unsolicited bulk messages.

5. Privacy and rights of others

Do not use the Service for:

  • collecting, processing or disclosing personal data without a lawful basis, or doxxing individuals;
  • unlawful surveillance, tracking, profiling or facial recognition of individuals;
  • inferring sensitive attributes such as health, sexual orientation, political views or religion without consent;
  • infringing copyrights, trademarks, trade secrets or other intellectual property rights.

6. Security and malicious code

Do not use the Service for:

  • creating, distributing or improving malware, ransomware, exploits or other malicious code;
  • gaining unauthorized access to systems, accounts or data, or bypassing authentication;
  • launching denial-of-service attacks or otherwise disrupting any network or service;
  • red-teaming any model — prompt injection, jailbreaking or other adversarial attempts to defeat its safeguards — without our prior written approval.

Authorized security research and defensive work are permitted where they comply with the law and the upstream provider’s policies.

7. High-risk uses

Do not rely on the Service, without appropriate qualified human review, for:

  • medical diagnosis or treatment, or other decisions affecting health and safety;
  • legal, financial, credit, insurance, employment, housing or education decisions with significant effects on individuals;
  • operating critical infrastructure, vehicles, weapons or other systems where failure could cause death, injury or serious damage.

8. Platform integrity

You must not misuse NixAPI itself, including by:

  • sharing, selling, renting or publicly exposing API keys or accounts;
  • reselling or redistributing the Service as a standalone API relay without our written permission;
  • registering multiple accounts, using fake identities or automation to abuse sign-up credits, promotions, referral rewards or redemption codes;
  • circumventing rate limits, quotas, billing, content filters or other technical or security measures;
  • sending traffic designed to probe, overload or degrade the Service, or scraping the website or console;
  • reverse engineering the Service or attempting to identify or directly access our upstream channels;
  • paying with funds or cryptocurrency derived from crime, using payment methods you are not authorized to use, or filing fraudulent chargebacks.

9. If you serve end users

If you make the Service available to others through your own product, you must:

  • have your own terms and privacy policy that are at least as protective as this AUP;
  • implement reasonable safeguards — such as content moderation, abuse monitoring and rate limiting — appropriate to your use case;
  • tell users when they are interacting with AI where required;
  • obtain any licenses, filings or approvals required for providing AI services in your jurisdiction;
  • respond promptly to our requests regarding abuse traced to your API keys.

You are responsible for all activity under your API keys, including activity by your end users.

10. Content controls and moderation

To reduce the risk of harmful use, we may apply technical and organizational controls to requests, including rule-based filtering, rate limiting, restricting access to certain models, and anomaly detection based on call logs and error logs. We do not store request or response content. Where an upstream provider enforces its own safety systems, those controls also apply to requests routed to it and may block or alter requests independently of us.

Nothing in this policy requires us to monitor all activity, but we reserve the right to review usage where necessary to operate, secure and protect the Service and to comply with law. The absence of enforcement does not mean a use is permitted.

11. Enforcement

If we determine, at our sole discretion, that a violation has occurred or is likely — including based on reports from upstream providers or third parties — we may, depending on its severity and without prior notice:

  • issue a warning;
  • block individual requests or restrict access to specific models or features;
  • rate-limit, suspend or revoke API keys;
  • freeze credits or suspend the account;
  • permanently terminate the account, with remaining credits forfeited;
  • report the activity to the appropriate authorities where required by law, and cooperate with lawful requests.

12. Reporting, appeals and changes

To report abuse, a suspected violation of this policy or a security vulnerability, email support@nixapi.com with “Abuse” or “AUP” in the subject line and as much detail as possible. If you believe an enforcement action against your account was made in error, you may appeal to the same address; appeals and cases that cannot be decided automatically are reviewed by a person.

We may update this policy at any time, including to reflect changes in upstream provider policies. The updated version takes effect when posted on this page, and continued use of the Service constitutes acceptance. This policy is provided in English and Chinese; if there is any inconsistency, the Chinese version prevails.
